Terms of Service

These Terms govern your use of sova: the sova app at app.appsova.com and the website www.appsova.com, operated by Seven Seconds Agency LLC ("Seven Seconds", "we", "us"). By creating an account or using sova, you agree to them for yourself and for the business you represent. If you're ordering food from a restaurant's sova ordering site, that restaurant's terms and the sova Platform Terms on that site apply to your order instead.

1. Who can use sova

sova is for restaurants and other food businesses. Accounts are opened by invitation. You must be at least 18 and authorized to act for the business you sign up.

2. Your account

Keep your sign-in details safe; you're responsible for what happens under your account. Invite only people you authorize to act for your business, and tell us straight away if you suspect unauthorized use.

3. Your restaurant's content

Your menus, prices, photos, logos and other content stay yours. You let us host, copy, display and process them as needed to run your ordering site and provide sova. You're responsible for keeping them accurate, including prices, ingredients, allergens and availability, and for having the rights to everything you upload.

4. Orders and payments

An order placed on your ordering site is a sale between you and your customer. You prepare and hand over the food, set your own policies, and are responsible for your taxes. Card payments are processed by Stripe, under Stripe's terms, into your own Stripe account; card details never reach us. Any fees for sova are as agreed between you and us.

5. Messages to your customers

sova sends your customers transactional messages about their orders on your behalf, by email and, where they choose it, by text. It sends marketing emails only to customers who opted in with you, each with an unsubscribe link. You agree not to use sova to message anyone who hasn't agreed to hear from you.

6. Text messages (SMS)

sova sends transactional text messages (order updates for restaurants' customers, and request and account updates for restaurants) only to people who choose to receive them. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help, or email contact@appsova.com. Carriers are not liable for delayed or undelivered messages. 7. Acceptable use

Use sova only for lawful purposes. Don't interfere with it, try to get into parts of it you weren't given access to, copy or reverse-engineer it, scrape it, or use it to publish anything false, misleading or infringing.

8. Availability and changes

We work to keep sova available and accurate, but it may be interrupted for maintenance or by events outside our control, and we may change or retire features.

9. Our intellectual property

The sova software, name, logo and design belong to Seven Seconds Agency LLC. If you send us feedback, we may use it without owing you anything.

10. Suspension and ending

You can stop using sova at any time. We may suspend or end your access if you break these Terms, or if your use puts sova, its users or others at risk. When your account ends, we handle its information as our Privacy Policy describes.

11. Disclaimer

sova is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim about sova is limited to the amount you paid us for sova in the 12 months before the claim.

13. Indemnity

You'll defend and hold us harmless against claims arising from your content, the food and service you sell, or your breach of these Terms.

14. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Disputes that can't be resolved informally go to the state or federal courts located in New York, and you consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms. The effective date at the top shows the version in force, and we'll tell account holders about significant changes. Using sova after a change means you accept it.
